  1. Criteria for arbitration resolution

If a project cannot be completed satisfactorily, both client and freelancer can request HireProsOnly’s intervention through arbitration. To make a fair decision, HireProsOnly takes into account the following factors:

  • What was initially agreed between client and freelancer: The proposal made by the freelancer and accepted by the client, the agreed delivery times, the scope of the project, the delivery formats, and everything related to what both parties agreed are taken into consideration. through HireProsOnly messaging.
  • The development of the project: The work carried out by the freelancer, the deliveries made, the client’s corrections, and all the conversations they had through the platform after the client has paid for the project.
  • Information provided by both parties: Once the project enters the arbitration process, both parties are asked to inform HireProsOnly about the work carried out and the information they consider appropriate to highlight.

Taking these aspects into consideration, HireProsOnly will analyze all the information and decide on the destination of the guarantee funds and the ownership of the work performed.

It is important to clarify that any conversation outside the platform, or work developed that is not supported within the platform, will not be valid to determine the resolution of the arbitration.

If you do not agree with HireProsOnly’s decision in arbitration, either party may appeal to a third party through binding arbitration before the American Arbitration Association (” AAA “), pursuant to the business rules then in effect for the AAA, except as provided herein (the “ AAA Rules ”).

The party who wishes to initiate arbitration must send to the other party a written Request for Arbitration, as specified in the AAA Rules. (The AAA offers a form called “Demand for Arbitration” ) .
